Terms & Conditions

Last Updated: January 2026 • Governed under the Motor Vehicles Act 1988, Carriage by Road Act 2007, and Indian Contract Act 1872.

1. Contractual Relationship

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Operator", or "Customer") and Sri Kanakamaha Lakshmi Piling Works ("Company", "we", "us", or "our"), governing your access to and use of the Trailer Loads Connect (TLC) software applications, web portal, APIs, and associated dispatch services.

By accessing or registering on our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the platform.

2. Platform Scope & Nature of Service

Trailer Loads Connect functions as an industrial technology and communications marketplace connecting verified trailer owners/drivers with verified load providers, factories, and logistics intermediaries.

Clarification of Carrier Role: Unless an explicit, bilateral, written transport contract or consignment note is issued directly by Sri Kanakamaha Lakshmi Piling Works under its corporate seal, TLC operates purely as a discovery facilitator.

The contract of carriage, freight settlement terms, and custody of goods remain strictly between the respective Load Provider (Consignor/Consignee) and the Trailer Owner (Carrier).

3. Operator Eligibility & Document Verification

To use our services, operators must satisfy the following minimum requirements:

  • Hold an active, unexpired commercial driving license with valid Heavy Motor Vehicle (HMV/HTV) endorsement.
  • Possess a valid Vehicle Registration Certificate (RC) reflecting commercial heavy transport endorsement.
  • Possess valid commercial vehicle fitness certification and up-to-date state/national road tax receipts.
  • Maintain active Third-Party Motor Insurance as mandated under Section 146 of the Motor Vehicles Act 1988.

4. Cargo Declaration & Prohibited Goods

Load Providers must provide truthful, complete, and accurate declarations regarding cargo descriptions, exact dimensions (length, width, height), gross weight, and hazardous properties.

Strictly Prohibited Goods:

Users are strictly prohibited from posting, offering, or carrying contraband materials, narcotics, unlicensed arms or ammunition, hazardous chemicals without valid TREM cards and Hazchem clearance, or stolen industrial property. TLC cooperates fully with police and transport authorities in prosecuting offenders.

5. Loading, Detention & Demurrage Rules

Unless mutually agreed otherwise in writing between the cargo provider and vehicle operator:

  • Standard free time allowed for loading is 24 hours from the recorded vehicle reporting time.
  • Standard free time allowed for unloading is 24 hours from the recorded vehicle arrival at destination.
  • Any detention beyond the 24-hour window entitles the vehicle operator to detention compensation as agreed upon prior to vehicle dispatch.

6. Transit Insurance Responsibility

It is the sole responsibility of the cargo owner (Consignor/Consignee) to ensure that high-value industrial machinery, piling rigs, and equipment are covered under comprehensive Marine Cargo Transit Insurance. TLC and vehicle drivers shall not be held liable for losses arising from transit accidents, unforeseen highway blockades, or Acts of God (force majeure).

7. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Sri Kanakamaha Lakshmi Piling Works and its officers shall not be liable for any indirect, punitive, consequential, or exemplary damages, including lost profits, mechanical delays, breakdown demurrage, or toll expenses.

8. Governing Law & Exclusive Jurisdiction

These Terms shall be interpreted and governed in accordance with the laws of the Republic of India. Any legal dispute, arbitration claim, or proceeding arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Visakhapatnam, Andhra Pradesh, India.
